Terms of Service

Please read these Terms of Service before creating a User Account.

The Freebok service (hereafter "Service") is offered by Osuuskunta Personare
(hereafter "Personare").  The Service is offered to individuals or entities,
subject to these Terms of Service.  In order to use the Service, members must
agree to the Terms of Service.  Users of the Service shall be deemed to agree to
and be bound by these Terms of Service by using Service.  If you do not wish to
be bound by these Terms of Service, do not use the Service.  As used herein, the
term "Member" shall refer to anyone who accepts these Terms of Service by using
the Service.

Violation of these Terms of Service may lead to the removal of the user account
without prior notice, or any notice, to Member.

1. Description of Service

Freebok service consists of tools for Web site owners.  These tools are focused
on Internet communication and include a bulletin board system and a virtual
guestbook system.  All data entered via these tools (hereafter "Content") will
be stored in a database server maintained by Personare.

The Service may contain features that require the purchase of Credits (hereafter
"Credit") in order to use the features.  The purchase of Credits is optional and
does not have an effect on the other use of the Service.

The Service is subject to reduction, modification, expansion, and/or elimination
at any time and for any reason, or for no reason at all, in Personare's sole
discretion, with or without prior notice, or any notice, to Member.  Personare
shall not be liable to the Member or any third party should Personare exercise
its right to modify or discontinue the Service.

2. Conditions of Use

By using the Service you agree to use the Service in a manner consistent with
all applicable local, state, federal, and foreign laws and regulations and in
accordance with these Terms of Service.

Members are responsible for everything contained on their own web site.  Each
Member, and not Personare, is responsible for the Content and for ensuring that
any such Content, whether posted by Member or any visitor to Member's Web pages,
meets the requirements of these Terms of Service at all times.  If any such
Content violates these Terms of Service, the Member is responsible for removing
the offending Content, even if the Member did not create or add the Content.

Member agrees not to transmit through the Service any unlawful, harassing,
libelous, abusive, threatening, harmful, vulgar, obscene or otherwise
objectionable material of any kind or nature.  Member further agrees not to
transmit any material that encourages conduct that could constitute a criminal
offense, give rise to civil liability or otherwise violate any applicable local,
state, national or international law or regulation.

Members can be held legally accountable for the Content if it includes, for
example, material protected by copyright, trademark, patent, or trade secret
law.

Personare does not verify, endorse, or otherwise vouch for the contents of any
web site using this Service.

Member shall not interfere with another Member's use and enjoyment of the
Service.  Member agrees not to resell the Service, without the prior written
consent of Personare.

Personare reserves the right to delete any Content stored in connection with the
Service at any time for any reason or no reason at all, in Personare's sole
discretion, with or without prior notice, or any notice, to Member.

Personare may terminate any Member's use of the Service (and access to any and
all Content related to Member's use of the Service) at any time, in Personare's
sole discretion, without prior notice, or any notice, for conduct that violates
local, state, federal, or foreign laws or regulations, these Terms of Service or
for material that Personare in its sole discretion believes is or may be
directly or indirectly harmful to other Members, to Personare or its
subsidiaries, affiliates, or business contractors, or to other third parties.
Members who have had their use of the Service terminated may not continue to
utilize member privileges in any manner or for any reason without the express
permission of Personare.

No Credits or advertising or other payments are refunded should the service be
cancelled or paused or the Member's account terminated for any reason.

3. Modification to Terms of Service

Personare reserves the right, in its sole discretion, to change, modify, add or
remove all or part of these Terms of Service with or without prior notice.  Any
modification or change will be posted at http://www.freebok.net/tos.html.
Additionally, the Member will be notified via the Private Message feature of the
Service.  Member shall be solely responsible for apprising him or her self of
modifications or changes to these Terms of Service.

The continued use of the Service constitutes an affirmative acknowledgment of
the agreement and its modifications and an agreement to abide and be bound by
the Terms of Service and its modifications.

4. Privacy Policy

Except as described in Presonare's Privacy Policy statement and as otherwise
disclosed in these Terms of Service, which is available on the Freebok Web site,
Personare will not disclose any information about any individual user except to
comply with applicable law or valid legal process, in circumstances where
Personare, in its sole discretion, deems appropriate at the request of law
enforcement officials, or to protect the personal safety of our users or the
public.  Please note, however, that some aspects of the Service require Member
to make certain information publicly available, such as the URL for Member's Web
pages and Member's user ID, which shall be posted on the Freebok Site in
connection with Member's use of the Service and which shall be used for
promotion of the Service.

If, in its sole discretion, Personare determines that law enforcement officials
or other necessary persons should be notified regarding any Content of Member's,
Personare will provide Member Content in question to the appropriate officials
without notice to the user.  Personare will cooperate with all law enforcement
efforts to locate persons who have posted Content that is illegal or that
promotes illegal conduct.  This may result in Personare disclosing to law
enforcement officials or other necessary persons user information and Internet
protocol addresses pursuant to valid legal process, in circumstances where
Personare, in its sole discretion, deems appropriate at the request of law
enforcement officials, or to protect the personal safety of our users or the
public.

5. Advertising

Personare has the exclusive right to run advertisements on pages displaying any
and all Content stored on the Service.  By posting any Content through the
Service that is to be hosted on Service and by enabling Content to be posted or
made accessible on the Service, you agree that Personare has the right to run
such advertisements on pages displaying such Content.  These advertisements may
include, but are not limited to, "banner" advertisements and "pop-up text"
advertisements.  The manner, mode, and extent of advertising by Personare is
subject to change at any time and for any reason, in Personare's sole
discretion, with or without prior notice, or any notice.  Personare has the
right to retain any and all revenues generated by any sales of advertisements on
the Service.

Member may not block the visibility of the advertisements in any way.

6. Limitations of Liability and Disclaimer of Warranties

MEMBER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT MEMBER'S SOLE RISK.  THE
SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

PERSONARE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR
IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

PERSONARE MAKES NO WARRANTY THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR
THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES
PERSONARE MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE
OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED
THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED.

PERSONARE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR
CONSEQUENTIAL DAMAGES, RESULTING FROM THE USE OR THE INABILITY TO USE THE
SERVICE OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING
FROM ANY GOODS OR SERVICES PURCHASE OR OBTAINED OR MESSAGES RECEIVED OR
TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED
ACCESS TO OR ALTERATION OF MEMBER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT
LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF
PERSONARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  SOME
JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR
INCIDENTAL OR CONSEQUENTIAL DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT
APPLY TO YOU.

7. Other Terms and Conditions

Member agrees to indemnify and hold Personare, its parents, subsidiaries,
affiliates, officers and employees, harmless from any claim or demand, including
attorneys' fees, made by any third party due to or arising out of Member's use
of the Service, the violation of this Terms of Service by Member, or the
infringement by Member, or other user of the Service using Member's computer, of
any intellectual property or other right of any person or entity.

Should one of the terms or conditions be invalid, it will not affect the
validity of the other terms and conditions.  The agreement is subject to the
Finnish law.
